South Carolina S0385, the Women's Childbirth Alternatives, Resources, and Education (CARE) Act, provides alternatives for pregnant women in incarceration facilities. It allows courts to supervise pregnant women on preincarceration probation if they do not pose a significant threat. These women must report any pregnancy loss within 72 hours. Facilities must report data on incarcerated women annually to the Department of Health and Human Services. Failure to surrender after childbirth is a Class A misdemeanor. The act takes effect upon approval by the Governor.
