South Carolina H5740 amends Section 8-29-10 of the South Carolina Code to require state agencies and political subdivisions to refer applicants' information to U.S. Immigration and Customs Enforcement if they are not lawfully present in the United States. The bill mandates that applicants who claim lawful presence must undergo verification through the SAVE program. Until verification is complete, the affidavit is presumed proof of lawful presence. If an applicant is found not to be lawfully present, their information, including unsatisfactory immigration status, must be referred to U.S.
