The Child Financial Assistance Act allows parents or guardians of minor children to petition the court for financial support from individuals who caused the death of the child's other parent or guardian. The court must hold an evidentiary hearing to determine if the person's conduct caused the death and order financial assistance if so. Payments must be made directly to the child's caregiver or through the South Carolina Department of Probation, Parole and Pardon Services or the South Carolina Department of Corrections if the person is incarcerated.
