Product Liability

Introduced·3/26/26
Introduced Text

Limits product liability claims against distributors and sellers to cases where the manufacturer cannot be identified.

The bill amends South Carolina's product liability laws to restrict claims against distributors, wholesalers, dealers, retailers, or sellers unless the manufacturer cannot be identified. Claimants must exercise due diligence to find the manufacturer. If a manufacturer is found, the claimant must dismiss claims against distributors and sellers. The bill incorporates comments to the Restatement of Torts, Second, and ensures that repealed or amended laws remain in effect for pending actions. This act takes effect upon approval by the Governor.
