Extends the time limit for commencing probate proceedings in South Carolina from ten to twenty years after a decedent's death.
This bill amends South Carolina's probate laws to extend the time limit for initiating probate proceedings from ten to twenty years following a decedent's death. It also allows for proceedings to be maintained in relation to the estate of an absent, disappeared, or missing person for up to three years after the conservator establishes the death of the protected person. If no proceedings are initiated within twenty years, it becomes incontestable that the decedent left no will and their estate passes by intestate succession.
