Introduced Text

South Carolina H5203 amends the statute of limitations for actions based on sexual abuse or incest.

South Carolina H5203 amends the statute of limitations for actions based on sexual abuse or incest. The bill specifies that such actions must be commenced within six years after the person becomes twenty-one years of age or within three years from the time of discovery of the injury and its causal relationship to the abuse, whichever occurs later. It also removes parental immunity as a defense against claims of childhood sexual abuse and allows victims to bring actions against bankruptcy estates at any time after the cause of action accrues.
