This bill amends South Carolina law to include premeditated murder as an aggravating circumstance for which the death penalty may be sought. Premeditated murder is defined as a situation where the offender created a plan of action and took steps in furtherance of that plan culminating in the commission of murder. The amendment ensures that any pending or vested rights, civil actions, special proceedings, criminal prosecutions, or appeals existing as of the effective date of this act remain unaffected.
