The Child Rapist Death Penalty Act amends South Carolina law to enforce the death penalty for individuals convicted of criminal sexual conduct with a minor, despite any Supreme Court rulings that might otherwise preclude such a penalty. The act allows the state to appeal directly to the Supreme Court of South Carolina if a ruling from the U.S. Supreme Court appears to prevent the imposition of the death penalty. The South Carolina Supreme Court must expedite these appeals and may summarily affirm if it finds that a U.S. Supreme Court ruling precludes the death penalty.
