Local government permit application reviews

Local planning and permitting entities must review and decide on building permit applications within 45 days.

The bill mandates that local planning commissions, planning departments, zoning boards, architectural review boards, and local building permitting entities review applications for building permits, certificates of occupancy, zoning variances, appeals, or licenses within 45 calendar days after submission. If a decision is not rendered within this timeframe, the application is automatically approved. The applicant can seek relief through a mandamus action in circuit court if the permit is not granted.
