South Carolina H3096 amends the state code to regulate gene therapy products by requiring conspicuous labeling of products that could potentially act as gene therapies. These products must be labeled "Potential Gene Therapy Product" unless they are known to be gene therapy products, in which case they must be labeled "Gene Therapy Product." The bill also mandates that entities producing, selling, or distributing such products must provide full disclosure of potential exposure to these products upon request and ensure informed consent is obtained from individuals who could be exposed.
