Introduced·1/14/25
Introduced Text

South Carolina H3016 mandates law enforcement officers to inform children of their rights before questioning them if they are taken into custody.

South Carolina H3016 amends the state code to require law enforcement officers to inform children of their rights before questioning them if they are taken into custody. The child must be advised of their right to remain silent, the potential use of any statements made against them, the right to have a parent, guardian, or custodian present, and the right to consult with an attorney. Any confession or admission resulting from interrogation is inadmissible unless the child's parent, guardian, custodian, or attorney is present.
