Rhode Island S2739 amends the workers' compensation reimbursement provisions related to the liability of third persons for damages. If an employee fails to file a lawsuit against a third party within two years and eight months after an injury, the employer or their insurance carrier may proceed with the lawsuit and be subrogated to the employee's rights. The employee must reimburse the employer for compensation paid as of the judgment or settlement date. The employee is entitled to withhold from the reimbursement amount a proportion of costs, witness expenses, and attorney fees.
