Rhode Island S2696 amends the low and moderate income housing act to restore provisions relating to the timing for counting affordable housing units.

Rhode Island S2696 amends the low and moderate income housing act to restore provisions relating to the timing for counting affordable housing units and the required findings for denial. Cities and towns that have low- or moderate-income housing in excess of ten percent (10%) of its year-round housing units which also have an inclusionary zoning ordinance which complies with § 45-24-46.1 may provide an applicant with more dwelling units than allowed by right under its zoning ordinance in the form of a density bonus to allow an increase in the allowed dwelling units per acre.
