Rhode Island H8272 amends the General Laws to add a new chapter on law enforcement sexual misconduct. It makes sexual contact or penetration between a law enforcement officer on duty and a detainee, arrestee, person in custody, or suspect a felony. Convictions carry a potential imprisonment term of up to 18 months for sexual contact and up to five years for sexual penetration. Force or coercion by the alleged victim or victims can be an affirmative defense, but consent of the victim is not a defense.
