Rhode Island H7759 provides a specific cause of action for nursing home patients whose rights are violated.

Rhode Island H7759 establishes a specific cause of action for nursing home patients whose rights are violated. Patients can seek actual and punitive damages, along with reasonable attorneys' fees and costs, in a court of competent jurisdiction. The Department of Health can also enforce the provisions of the chapter by maintaining an action in the name of the state. Violations of the rights of nursing home patients are subject to misdemeanor penalties, including fines up to $500 and/or six months in jail. This act takes effect upon passage.
