Pennsylvania SB773 amends the act of April 9, 1929, to redefine the "cost of the retailer" in cigarette sales and licensing. It sets a presumed cost of doing business by the retailer, expressed as a percentage of the basic cost of cigarettes. The presumed cost will be nine percent from July 1, 2026, to December 31, 2026, ten percent from January 1, 2027, to December 31, 2027, eleven percent from January 1, 2028, to December 31, 2028, and twelve percent from January 1, 2029, onward. If a retailer can prove a lesser cost of doing business, it may be used for up to twelve months.
