Pennsylvania SB142 prohibits enforcement of non-compete agreements in broadcast employment contracts.

Pennsylvania SB142, known as the Broadcast Freemarket Agreement Act, prohibits enforcement of covenants not to compete in broadcast employment agreements. These agreements, which restrict a broadcast employee's ability to move to a new employer or perform services within a geographic area, are deemed contrary to public policy and are void and unenforceable. The act does not limit agreements on maintaining information as confidential or as a trade secret, nor does it limit the geographic area for such confidentiality. The act will take effect in 60 days.
