Pennsylvania HB811, known as the Fraudulent Misrepresentation of a Candidate Prevention Act, creates civil liability for entities disseminating campaign advertisements containing artificially generated impersonations of candidates. A covered person, defined as a candidate, firm, political committee, or other entity, can be held liable if they disseminate synthetic content within 90 days before an election with willful or reckless disregard for influencing the outcome. A candidate can bring a civil action against the covered person for punitive damages, attorney fees, and litigation costs.
