Pennsylvania HB621 amends Title 18 of the Pennsylvania Consolidated Statutes to include a new offense of benefit transfer device fraud. This offense applies to unauthorized aliens who possess, use, or attempt to use a benefit transfer device, which is defined as the Pennsylvania ACCESS card or electronic benefit transfer card. Each instance of possession or use constitutes a separate offense, graded as a felony of the third degree. The act will take effect 60 days after its passage.
