Pennsylvania HB326 repeals the offense of drug delivery resulting in death and creates a new offense of drug delivery resulting in death or serious bodily injury. The new offense applies when a person unlawfully and intentionally administers, dispenses, delivers, gives, prescribes, sells, or distributes a controlled substance or counterfeit controlled substance, and another person dies or suffers serious bodily injury as a result.
