Pennsylvania HB2697 modifies the burden of proof in due process hearings for exceptional children.

Pennsylvania HB2697 amends the Public School Code to change the burden of proof in due process hearings for exceptional children. In most cases, the local educational agency must prove its position, but if the case involves a private school placement chosen by the child's parent or guardian, the parent or guardian must prove the appropriateness of the placement. This act will take effect in 60 days.
