Introduced Text

Pennsylvania HB1779 mandates transparency and fairness in algorithmic pricing by requiring disclosures and prohibiting the use of protected class.

HB1779 requires entities to disclose when personalized algorithmic pricing uses consumer data, stating "THIS PRICE WAS SET BY AN ALGORITHM USING YOUR PERSONAL DATA." It prohibits using protected class data in pricing, marketing, or selling goods and services if it results in discrimination or differential pricing. The Office of Attorney General can investigate violations, and courts can issue injunctions without proof of injury. Consumers can file complaints with the Bureau of Consumer Protection. The act takes effect in 60 days.
