HB1616

In offenses against the family, further providing for the offense of dealing in infant children; and, in depositions and witnesses, providing for sentencing considerations for child victim offenders.

Chamber Passed·6/16/26

Pennsylvania HB1616 amends sentencing laws for child offenders who were victims of sexual conduct.

Pennsylvania HB1616 amends Title 42 of the Pennsylvania Consolidated Statutes to allow courts to consider sentencing alternatives for child offenders who were victims of prohibited sexual conduct. If a child is convicted of an offense and the court finds that the child was a victim of prohibited sexual conduct or acted under substantial emotional distress, the court may depart from mandatory minimum sentences, impose a determination of guilt without sentencing, transfer the case to juvenile hearings, or reduce or waive fines, court costs, or restitution.
