Pennsylvania HB1363 amends Title 18 of the Pennsylvania Consolidated Statutes to establish the offense of assault of an emergency responder. It defines a felony of the second degree for intentionally or knowingly causing an emergency responder to come into contact with fentanyl or its derivatives, such as salts, isomers, and salts of isomers, while the responder is in the performance of their duty. The bill also defines a felony of the third degree for causing an emergency responder to come into contact with fentanyl or its derivatives while in unlawful possession of the substance.
