Oklahoma SB1716 modifies the Security Breach Notification Act to shield private entities from class action lawsuits for cybersecurity incidents unless the entity acted with willful and wanton conduct or gross negligence. The bill also allows entities that use reasonable safeguards and comply with notice requirements to avoid civil penalties. It grants the Attorney General or a district attorney exclusive authority to enforce the act, with the potential for actual damages and a civil penalty of $75,000 for non-compliant entities. The changes take effect on a date specified within the bill.
