Oklahoma SB1084 modifies indigent representation eligibility procedures and removes the application fee requirement.

Oklahoma SB1084 amends the application process for indigent representation by the Oklahoma Indigent Defense System. It removes the requirement for applicants to pay a fee when submitting their application. The bill also modifies eligibility procedures, including establishing a rebuttable presumption that a defendant unable to post bail is eligible for indigent representation. The Chief Judge of the Judicial District or a designee will make the initial determination of indigency based on the defendant's application and the rules provided. The bill provides an effective date for these changes.
