Int Text

Oklahoma HB3792 prohibits first-party claimants from collecting collision or comprehensive claims if they were unlawfully operating a motor vehicle.

Oklahoma HB3792 defines "unlawfully operating a motor vehicle" as driving without a valid license, with a revoked or cancelled license, or using fraudulent identification. The bill prohibits first-party claimants who were unlawfully operating a motor vehicle from collecting collision or comprehensive claims. It clarifies that liability coverage remains effective for such claimants. The bill also permits insurers to use Department of Public Safety license status data. The new law is to be codified in the Oklahoma Statutes as Section 7-117 of Title 47.
