This bill enables hospitals to petition the superior court for permission to discharge incapacitated adult patients when no authorized person is available to make health care decisions or consent to discharge. The hospital must wait five business days after receiving the written concurrence of a second physician before filing the petition. The court must issue a decision within five business days of receiving the petition. This process applies only to patients aged 18 years or older.
