North Carolina bill H913 amends Chapter 160D of the General Statutes to allow for punitive damages and attorney's fees against local governments for unfair or deceptive actions in development approvals. The court may award up to 10 times the damages and reasonable attorney's fees if the local government acted in a flagrantly unfair or deceptive manner. The bill also specifies that attorney's fees will not be awarded if the local government acted in reasonable reliance on court judgments, orders, or published opinions.
