North Carolina H81 requires insurance institutions and agents to notify applicants or policyholders about how vehicle telematics data will be used, obtain written consent, and inform them that consent can be revoked at any time. It also mandates that revocation of consent must be communicated and effectuated within 24 hours. Violation of these provisions constitutes both an unfair trade practice and an unfair and deceptive trade practice. The act defines "vehicle telematics" as any device or software that transmits and stores driving data.
