Modify Appointment Process for DA Vacancies

Introduced·3/20/25

North Carolina H478 modifies the appointment process for filling district attorney vacancies.

North Carolina H478 revises the procedure for appointing district attorneys when vacancies occur. The Governor now appoints from a list of up to three qualified candidates recommended by the General Assembly. If recommendations are not made within 30 days, the Governor appoints a qualified person directly. The appointee serves until the next election, more than 60 days after the vacancy. The act also clarifies the recommendation process for political party affiliations and applies retroactively to certain vacancies.
