New Mexico SB100 amends the definition of "dwelling" for burglary and aggravated burglary statutes.

New Mexico SB100 amends the definition of "dwelling" to include any personal space with an enclosure that creates an expectation of privacy. The bill also modifies the burglary statute to include unauthorized entry into a vehicle, watercraft, aircraft, or other structure with intent to commit a felony or theft. Aggravated burglary is defined as unauthorized entry into a structure with intent to commit a felony or theft while armed with a deadly weapon or committing a battery.
