Proposes constitutional amendment to provide that only Legislature may determine affordable housing obligations.

Introduced·1/9/24
Introduced Text

Proposed constitutional amendment to shift determination of affordable housing needs from courts to the New Jersey Legislature.

This bill proposes a constitutional amendment to change how affordable housing needs are determined in New Jersey. Currently, the courts decide the number of affordable housing units needed and the methods for fulfilling this obligation. The amendment would transfer this authority to the Legislature, allowing it to set affordable housing needs and fulfillment methods through general laws. The amendment would be subject to a public vote at the next general election.
