New Jersey S978 criminalizes the use of electronic tracking devices or applications to surreptitious track or determine the location of another.

New Jersey S978 makes it a fourth degree crime to knowingly install or place, or cause the installation or placement of, an electronic tracking device or tracking application to track or determine the location of another person, with intent to initiate or facilitate an unlawful act. The crime is punishable by up to 18 months in prison, a fine of up to $10,000, or both. The bill exempts certain lawful uses, such as tracking by a parent or guardian of a minor child, tracking for monitoring a person at risk of injury or death, and tracking during lawful business transactions.
