New Jersey S889 makes it a fourth-degree crime to knowingly and actively participate in a criminal street gang and to purposely promote, further, or assist others in the commission of certain offenses. These offenses include robbery, carjacking, aggravated assault, assault, aggravated sexual assault, sexual assault, arson, burglary, kidnapping, extortion, tampering with witnesses and informants, or violations related to homicide or firearms. The bill defines "criminal street gang" as three or more persons associated in fact, meeting two of seven criteria indicating gang membership.
