New Jersey S856, the "Fairness in Women's Sports Act," requires that public and nonpublic schools, as well as institutions of higher education, designate athletic or sports teams based on biological sex. It prohibits athletic teams or sports designated for females from being open to males. If a student's sex is disputed, the student must establish sex by presenting a signed physician's statement based on internal and external reproductive anatomy, normal endogenously produced levels of testosterone, and an analysis of the student's genetic makeup.
