New Jersey S446 requires health benefits plans to cover at least one abuse-deterrent opioid analgesic drug product per opioid analgesic active ingredient. The bill prohibits prior-authorization requirements or other utilization review requirements for an opioid analgesic from forcing a covered person or enrollee to use a non-abuse-deterrent opioid analgesic before accessing an abuse-deterrent product. Cost-sharing for a generic abuse-deterrent opioid analgesic drug product must not exceed the lowest cost-sharing level applied to a generic non-abuse-deterrent opioid drug.
