New Jersey S4110 prohibits using fictitious former prices in advertising discounts.

New Jersey S4110 makes it an unlawful practice under the consumer fraud act to use a fictitious former price in advertising discounts for merchandise or services. This bill codifies State regulations concerning unlawful practices under the consumer fraud act. A former price is deemed fictitious if it cannot be substantiated by the Director of the Division of Consumer Affairs. A person aggrieved by a violation may bring a civil action in the Superior Court, which can award reasonable attorney's fees, litigation costs, and damages.
