New Jersey S410 provides for direct State payment of special education costs for certain students.

New Jersey S410, known as the Fairness in Special Education Funding for Student Success Act, establishes a system for the State to directly pay for the cost of special education and related services for students who require a high needs placement. This bill eliminates the category of State aid for extraordinary special education costs. If a school district anticipates that the cost of providing the special education and related services included in a student’s Individualized Education Program (IEP) will exceed $55,000, then that student is considered to require a high needs placement.
