This bill upgrades the crime of invasion of privacy under certain circumstances and eliminates the presumption of nonimprisonment. It raises the penalty for observing another person without consent in a private dressing stall to a third-degree crime, and for photographing or disclosing such images to a second-degree crime. It also removes the presumption of nonimprisonment for these offenses. The bill applies to offenses committed on or after its effective date.
