New Jersey S3255 establishes a process to exempt municipalities from fair share affordable housing obligations if they are designated as extensively.

New Jersey S3255 directs the Commissioner of Community Affairs to exempt a municipality from fair share affordable housing obligations if designated as extensively flood-prone. This exemption would protect the municipality from potential builder’s remedy actions to compel housing construction. The designation would be based on factors such as flood insurance paid by property owners, the number of repetitive loss and severe repetitive loss properties, and other relevant information.
