Prohibits employers from taking adverse actions against employees unable to work due to a declared state of emergency.

New Jersey S3108 prohibits employers from discharging or taking adverse actions against employees who cannot work due to a declared state of emergency. The bill also prohibits employers from requiring employees to use sick or personal leave for absences due to the emergency. Employees must notify employers of their absence and return to work as soon as possible after the emergency is resolved. The bill defines "employee" to exclude essential healthcare personnel and "employer" to exclude public safety agencies and certain contractors.
