New Jersey S3065 amends the state's fair housing law to exclude environmentally sensitive and flood-prone land from being designated as vacant or available for affordable housing construction. This includes land regulated by any state or federal agency, such as the Highlands Water Protection and Planning Council or the Flood Hazard Area Control Act. Municipalities will no longer be required to utilize such land for affordable housing purposes. The bill takes effect immediately upon enactment.
