New Jersey S2863 establishes the crime of recklessly discharging a firearm using live ammunition rounds unlawfully or without a lawful purpose. A first offense is a disorderly persons offense, a second offense is a crime of the fourth degree, and a third or subsequent offense is a crime of the third degree. The offense is upgraded by one degree if it occurs within 100 yards of an occupied structure or an educational institution, school bus, or child care facility. Convictions under this section do not merge with other convictions, and sentences for multiple offenses run consecutively.
