Introduced Text

New Jersey S2622 grants courts discretion in expunging records of domestic violence arrests not resulting in conviction.

New Jersey S2622 amends the law to give courts discretion in expunging records related to domestic violence arrests that do not result in a conviction. Currently, the Superior Court must order the expungement of records when proceedings are dismissed, the person is acquitted, or the person is discharged without a conviction. This bill allows the court to bar the relief for six months if the county prosecutor objects, providing an opportunity to assess the situation and potential risks to victims. The court must state its reasons if it does not order immediate expungement.
