New Jersey S2540 amends existing law to require courts to provide certain defendants with a referral for a mental health and substance abuse evaluation. This requirement applies when a court orders the pretrial release of a defendant, unless the defendant is already subject to a condition that includes psychological or psychiatric treatment, including treatment for drug or alcohol dependency. The evaluation provider must notify the court if the defendant completes the evaluation.
