New Jersey S2438 requires Pretrial Services to recommend pretrial detention for certain repeat offenders.

New Jersey S2438 mandates that Pretrial Services recommend pretrial detention for eligible defendants who have been arrested on two or more prior separate occasions, with pending charges at the time of the current complaint-warrant, and where the current charge or at least one of the pending prior charges is an initial charge for an indictable offense or an initial charge for a disorderly persons offense involving domestic violence.
