The "Patient and Provider Protection Act" sets forth regulations for pharmacy benefits managers, including ensuring that contracts with pharmacies are presumed to be "contracts of adhesion" in disputes. It mandates that pharmacy benefits managers reimburse contracted and network pharmacies at least at their acquisition cost and independent pharmacies at a rate up to five percent lower, but not less than their acquisition cost. The act also prohibits pharmacy benefits managers from conditioning rebates on the exclusion of generic drugs and from marketing with inaccurate information.
