New Jersey S234 requires spousal consent for certain pension payout options under TPAF, JRS, and PERS.

New Jersey S234 mandates that members of the Teachers’ Pension and Annuity Fund (TPAF), the Judicial Retirement System (JRS), or the Public Employees’ Retirement System (PERS) obtain written spousal consent before electing a retirement benefit payable only during their lifetime or any option providing a benefit to the spouse less than half of the member’s retirement allowance. The spouse’s consent must be witnessed by a representative of the Division of Pensions and Benefits or a notary public.
