New Jersey S1887 creates the offense of financial exploitation of the elderly. The bill defines "elderly person" as someone 60 years of age or older suffering from a disease or infirmity associated with advanced age or a mental condition that renders them incapable of deciding whether to give or withhold consent to taking, obtaining, or withholding their property. A "person in a position of trust" includes relatives, joint tenants, fiduciaries, caregivers, and others living with or providing home care services to the elderly person.
